Reasonable adjustments
The law of 1975 provided for gradual adjustments to guarantee the accessibility of public transport, public buildings, places of work and accommodation. However, these provisions have not generally been implemented.
The guidance law on public transport of 30 December 1982 only referred to adjustments for handicapped people at a reasonable cost. The law of 13 July 1991, which was intended to guarantee the accessibility of buildings, was applied very slowly and only to new collective buildings and public places excluding shops. In addition, dispensations could be obtained fairly easily. The new law, section III of which deals with accessibility in all its forms, is intended to rectify this situation. This section III, “Building context, transport and new technology”, begins with article 21 which amends article L. 111-7 of the construction and accommodation code:
"The architectural provisions, layout and equipment inside and outside residences and accommodation premises, regardless of whether these are the property of private or public individuals, public establishments, facilities open to the public and workplaces must be such that these premises and facilities are accessible to handicapped people irrespective of the type of handicap, notably physical, sensorial, cognitive, mental or psychic".
Dispensations based purely on technical or architectural reasons will be strictly controlled and substitution methods will be provided for buildings open to the public or performing a public service assignment. In addition, "in the event a dispensations, handicapped persons shall be entitled to a transfer to premises suited to their needs" added by the Assembly. Article 24 stipulates that "the transfer chain, which includes the building context, road maintenance, adaptations of public areas, transportation systems and their intermodality, is organised to provide full access to handicapped people or those with limited mobility". Upon renewal, transportation means must be replaced with transport accessible to handicapped people, with the entire network becoming accessible within ten years. In the event of a technical impossibility emerging, alternative means of transportation must be organized without any extra charge for the handicapped user.
