Article 9 of the draft presented by the department of health to the Senate on 28 January stated the following:
“I. – The following paragraph has been inserted in the penultimate paragraph of article L. 323-9 of the labour code :“Employers shall take appropriate steps to ensure that handicapped workers can access, carry out or develop in employment or obtain training, provided that the costs relating to the implementation of these measures are not excessive, particularly in view of the financial assistance which may compensate for all or some of the expenses incurred by the employer in this context. ”.
II. - A new article L. 212-4-1-1 has been inserted after article L. 212-4- of the same code, as follows: Art. L. 212-4-1-1: “Handicapped workers benefiting from the employment obligation referred to in article L. 323-3 may, according to the firm's possibilities, benefit from individual time adaptations to facilitate their access to employment, their professional activities or to maintain their position ”.
After discussing and voting on the amendments, the Senate adopted the following version:
I. - The following paragraph has been inserted in the penultimate paragraph of article L. 323-9 of the labour code : “Employers, in particular the state, local communities and their public establishments, shall take appropriate steps according to the requirements in a specific situation, to enable handicapped workers benefiting from the employment obligation referred to in article L. 323-3 to access employment or maintain a position corresponding to their qualifications, carry out or develop in employment or obtain training provided that the costs relating to the implementation of these measures are not excessive, particularly in view of the financial assistance which may compensate for all or some of the expenses incurred by the employer in this context. ”.
II. - Article L. 212-4-1-1 has been inserted after article L. 212-4- of the same code, as follows:
“Article L. 212-4-1-1. - Handicapped workers benefiting from the employment obligation referred to in article L. 323-3 may, according to the firm's possibilities, benefit from individual time adaptations to facilitate their access to employment, their professional activities or to maintain their position. Family assistants and people close to the person in a situation of handicap may benefit from individual time adaptations to help them to assist this person in a situation of handicap ”.
