The parties had been dealing with each other over a number of years on the basis of an oral agreement only. Recently however Ms White had decided to incorporate their general trading terms into a written standard form contract. One of these terms state that:
The seller accepts no liability for any goods provided under the contract which do not conform to the contract description, and that in any case such claim for misdescription the loss shall be quantified as one third of the total purchase price of the goods.
