In the Lac Lanoux Arbitration (Spain v. France), 12 R.I.A.A.28] (Nov.16,1957) for instance, an arbitral tribunal stated that France could not ignore Spanish interests regarding a planned hydraulic construction project on the Carlo River. The tribunal, however, did not go as far as the Convention, explaining that “if, in the course of discussions, the downstream State submits schemes to it, the upstream State must examine them, but it has the right to give preference to the solution contained in its own scheme provided that it takes into consideration in a reasonable manner the interests of the downstream State.”
